Neurocognitive enhancement, or cosmetic neurology, offers the prospect of improving the learning, memory and attention skills of healthy individuals well beyond the normal human range. Much has been written about the ethics of such enhancement, but policy-makers in the USA, the UK and Europe have been reluctant to legislate in this rapidly developing field. However, the possibility of discrimination by employers and insurers against individuals who choose not to engage in such enhancement is a serious threat worthy of legislative intervention. (...) While lawmakers should not prevent individuals from freely pursuing neurocognitive enhancement, they should act to ensure that such enhancement is not coerced. This paper offers one model for such legislation, based upon a proposed US law, the Genetic Information Nondiscrimination Act of 2008, to address precisely this particular pitfall of the impending neuroscience revolution. Arguably, the most promising and compelling route to demonstrating the significance of Hegel’s thought to contemporary philosophy has been the series of recent readings that construe Hegel as continuing and completing Kant’s Copernican turn. Paul Redding explicitly locates his interpretation within this program, seeing the hermeneutic dimension of Hegel’s thought as providing for the possibility of continuing the Kantian project. Kant’s Copernican turn can be loosely stated as the procedure of reflectively uncovering unexperienced conditions of experience that contribute to the (...) nature of experience in ways that require its further re-determination and re-description. What a hemeneutic take on this reflective procedure adds is that foremost among those conditions are contexts of intersubjective or dialogical relations—structures of recognition. While perhaps disappointing to anyone interested in the problem of textual interpretation, there is finally nothing more to Redding’s account of Hegel’s “hermeneutics” than the establishing of recognitive structures as forming the ultimate horizon of human experience. I take Redding’s relentless tracking of the problem of recognition to be one of his book’s virtues. (shrink)

John Locke claimed that: ‘We never finding, nor conceiving it possible, that two things of the same kind should exist in the same place at the same time, we rightly conclude that, whatever exists anywhere at any time excludes all of the same kind, and is there itself alone’. He argued that, otherwise, ‘The notions and names of identity and diversity would be in vain, and there could be no such distinctions of substances or anything else one from another’. More (...) recently Professor D. Wiggins has made a similar claim for similar reasons. I shall maintain that, even if we accept the general outline of the essentialist account of identity given by Wiggins in his book, the claim that two things of the same kind cannot be in the same place at the same time should be rejected, until better reasons are forthcoming. Arguably, there is no gesture more typical to philosophy than its repudiation, the sense that philosophical endeavor is a symptom of the pathologies or dislocations of everyday life it seeks to remedy. Throughout the nineteenth century—in the writings of the German Romantics, Young Hegelians, Marx, Kierkegaard, and Nietzsche—the repudiation of philosophy is a constant. Sometimes this repudiation takes a reflective form in which traditional philosophical claims are translated into another vocabulary, or are deflated ; sometimes alternative methods are adopted that (...) attempt to undermine, explain away, what is thought of as uniquely philosophical; sometimes rhetorical strategies are adopted that aim to bring about a “conversion” in the reader away from philosophy and toward a more fully immanent or existential self-understanding; and sometimes that more everyday self-understanding that is to be the antidote to philosophical reflection is construed as not yet available but would come to be in an ideal or utopian future if particular radical transformations of current practices were accomplished. Apart from Kierkegaard, these attempts typically construe themselves as continuous with the critique of religion, as if philosophy were nothing but religious excess in rational dress, and thus continuous with modernity’s drive toward secularity. Because the stakes of repudiation are inevitably normative—the protest against philosophy for the sake of a more “realistic,” more truly natural or historical, conception of what is rational or good—the critique of philosophy becomes, despite itself, philosophical, burdened with presuppositions it can neither sustain nor forgo. In brief, this is the lesson of Daniel Brudney’s meticulous and patient excavation of the writings of the young Marx. (shrink)

The problem of 'no fault' compensation for patients who suffer adverse effects as a result of their participation in clinical trials is discussed in the light of the guidelines issued by the Association of the British Pharmaceutical Industry (ABPI) and our recent experiences in reviewing protocols submitted to the local ethics of surgical research sub-committee. We have found a variety of qualifications being applied by pharmaceutical firms which are not in the spirit of the guidelines, let alone the interests of (...) the patient, and we suggest a means whereby the patients can be assured of fair treatment in the event of 'no fault' injury. T. Rosenmeyer as 'the Aristotelians of the West, Unincorporated'. In our monthly meetings we translate and discuss Greek philosophic texts. For the past two years the group has been working on Aristotle's 'Physics'.

In the Preface to Negative Dialectics, Adorno states that the primary ambition of the book is to find a substitute for the “supra‐ordinated” concept and to “break through the deception of constitutive subjectivity.” For a book whose ambition is to renew the Marxist idea of critique, these are puzzling claims. The notions to be criticized are Kant's in The Critique of Pure Reason ; Adorno, from his earliest studies with Siegfried Kracauer, had taken Kant's theoretical philosophy as expressing the deepest (...) conceptual and normative commitments of capital. This chapter attempts to specify what the expressive relation between idealist conceptuality and capital is; why Adorno took the transcendental unity of apperception to express a society that was unconscious about itself; and precisely how negative dialectics is throughout key to a critique of Kant's philosophy. There are two passages in which the poet introduces a full moon to accentuate a particular aspect of a scene in his narrative; 1.1228–33 and 4.166–71. I shall concentrate on the second. Commentators have contributed various suggestions but failed to understand the specific erotic-nuptial connotation of the full moon. The same applies to the more specialized contributions of Drogemiiller and Rose. I shall first present the evidence for the nuptial associations of the full moon, then apply this idea to the (...) Apollonian passages, especially 4.166–71, and finally add a remark about the special effect obtained by Apollonius here in relation to an Homeric passage. (shrink)

In an important recent article T. C. W. Stinton reaffirmed the case that in Aristotle's Poetics, ch. 13, has a wide range of application. I do not wish to dispute the general conclusion of what seems to me a masterly analysis of the question but simply to discuss two areas where Stinton's argument may be thought defective–the interpretation of the examples given by Aristotle in Poetics 13, 5 3all and 53a2O–1 and the problem of the contradiction between 13, 53a13–15 and (...) 14, 54a4–9. Continuing the dialogue: postcolonial feminist scholarship and Bourdieu — discourses of culture and points of connection Postcolonial feminist theories provide the analytic tools to address issues of structural inequities in groups that historically have been socially and economically disadvantaged. In this paper we question what value might be added to postcolonial feminist theories on culture by drawing on Bourdieu. Are there points of connection? Like postcolonial feminists, he puts forward a position that aims to unmask oppressive structures. We argue that, (...) while there are points of connection, there are also epistemologic and methodologic differences between postcolonial feminist perspectives and Bourdieu's work. Nonetheless, engagement with different theoretical perspectives carries the promise of new insights — new ways of ‘seeing’ and ‘understanding’ that might enhance a praxis‐oriented theoretical perspective in healthcare delivery. This study investigated the differences between past and future temporal discounting in terms of neural activity in relation to temporal distance. Results show that brain regions are engaged differently in past and future temporal discounting. This is likely because past temporal discounting requires memory reconstruction, whereas future temporal discounting requires the processing of uncertainty about the future. In past temporal discounting, neural activity differed only when preferences were made between rewards received one hour prior and rewards received further in the (...) past. The peak amplitudes of P2 and P3 varied as the temporal distance increased from 2 weeks to 50 years. In future temporal discounting, neural activity differed only when preferences were evaluated between two delayed rewards. The delay conditions and had a significant influence on P2 and N2. Findings indicate the existence of different decision-making systems operating in past and future temporal discounting. (shrink)

Some patients with schizophrenia are not told their diagnosis. The moral, clinical and practical issues involved in telling or not telling the patient are discussed. In some cases a relative is told the diagnosis but not the patient. The implications for the family and clinical outcome are outlined. A case history illustrating some of these issues is presented.

The current concepts of autonomy, surrogate autonomy and informed consent often lead to futile and expensive care at the ends of life. They may impinge on the dignity of the patient as well as subject society to unwarranted expense. In order to provide affordable healthcare for all, these concepts are in need of modification.

Paul-Mikhail Podosky introduces the notion of other-oriented hermeneutical injustice and argues that non-human animals are often the subjects of such injustice. In this paper, I argue that although the notion of other-oriented hermeneutical injustice is coherent, Podosky’s examples – including his primary case of non-human animals – are not instances of it. I attempt to show that an epistemology of ignorance serves as a better theoretical basis for Podosky’s argument. In the final section of the paper, I discuss a case (...) that, at first glance, seems to be one of other-oriented hermeneutical injustice. However, I argue that ultimately an epistemology of ignorance gives us a better account of the case. (shrink)

The goal of Hegel's Phenomenology of Spirit is to achieve absolute knowing. Minimally, knowing can be absolute only if it is unconditioned or unlimited; that is, only if it is not essentially contrasted with some other possible knowing—say, God's—or is not restricted such that it necessarily does not pertain to certain items—say, freedom of the will, the immortality of the soul, or God. Knowing can be absolute only if these items, appropriately interpreted, are within its scope. However, if it can (...) be shown that human knowing is not limited or restricted in either of these two ways, it would then follow that we cannot contrast our conceptual scheme—human knowing as such—with the world, and, hence, we cannot even notionally contrast human knowledge of appearances with things in themselves. Initially, it is in this quite narrow sense that Hegel's project in the Phenomenology is to transform Kant's subjective or limited idealism into objective or absolute idealism by showing that items Kant took to be necessarily extrinsic to human knowing are intrinsic and constitutive of it. Thus, if we were to translate Hegel's dictum that the ground of science in general is "pure self-recognition in absolute otherness" back into Kant's lexicon, it would state that we achieve full apperceptive self-awareness, full categorial selfawareness of ourselves as knowers, only in the thing in itself. Within Hegel's own system, achieving the standpoint of absolute knowing is a necessary condition for doing logical science, and, by implication, the first part of the system as a whole, because only by demonstrating that the necessary conditions of human knowing cannot, even notionally, be contrasted with the world in itself is it possible to then work out a system of logical categories that are simultaneously categories of thought and categories of being. Ethical physicians need to share their biases and prejudices and articulate alternatives and also be tolerant of the decisions of their patients and families.I believe that I am a moral, caring, dedicated doctor working with children and parents who are often faced with ethical problems of large and small dimensions. There is no question that these decisions should be ethical, but, in general, I find ethical theory of little day-to-day use. Indeed, even when an ethicist joins me in a discussion (...) of “What should I do?”, or more appropriately, “What should I advocate be done?”, I usually find their additions to the discussion wanting. Ethical theory gives guidance but does not seem to provide sufficient help in decisions for the individual case: What will be best for the infant with spina bifida while still in utero? Termination of the pregnancy? Birth and long-term care? What is best were that same child already born with a high paraplegia and hydrocephalus? What is best for the infant with a major malformation of the brain and uncontrollable seizures whose only hope for controlling the seizures is removal of half of the brain? What is best for the family in each of these situations and the many others I have encountered? What is best for society?I have been called a Hegelian pragmatist, although my knowledge of Hegel is minimal. I think that the term pragmatist is a badge of honour, because, on the front lines of clinical decision-making, I do not have the philosopher’s luxury of days or weeks for managing words. As a pragmatic doctor, I am forced to be a person of action or inaction. I must make a decision and advocate for the position I take.I am clearly a utilitarian, as I strive to produce the greatest good …. (shrink)
